Apple and publishers reportedly willing to abandon iBooks ?agency model? to appease Justice Department

Under the traditional book-selling model, retailers like B&N, Amazon, and others could get 50% or more of the revenue from the sale of a book. Under Apple's "agency model", they get 30%. The traditional model is retailer-centric. Apple's model is publisher-centric. This upsets the US Justice Department. Why? Because under the old model, the retailer set the price and so could sell the book at any price they wanted, even at a loss. Under Apple's model, the publisher sets the price, so there's no retailer discount. What's more, part of Apple's deal is a "most favored nations" clause that means publishers can't sell to competitors for less than they could sell to Apple, thus making deep discounts for consumers pretty much impossible. According to Reuters, however, this may be about to change.

PSA: TurboTax on Android is free through Sunday if you start your taxes before then

If you've ever filed your taxes on an iPad, you know Intuit's TurboTax app is free to download, but that you'll have to pay up once you're ready to submit those returns. But, in an effort to promote its newish apps for Android tablets and the Kindle Fire, the company's giving the entire number-crunching cow away for free -- at least through this weekend. Just download between tomorrow (Friday) and Sunday and make sure you start your taxes before Monday (it's okay if you finish them later). To be clear, this includes both federal and state-level taxes, which you'd normally pay for separately for $29.99 and up. Another quid pro quo: this won't work on handsets, even though the Kindle runs a customized version of Android 2.3. If you own a tablet it should run smoothly on Honeycomb and Ice Cream Sandwich, though. In any case, to those of you who've been putting off your taxes, happy downloading, procrastinators.

Trayvon witness' mom: Police doubt self-defense

Cheryl Brown, accompanied by her attorney, Alisia Adamson, describes the police interview of her 13-year-old son, a witness in the Trayvon Martin slaying.

By M. Alex Johnson, msnbc.com

The mother of a 13-year-old witness in the slaying of Trayvon Martin said Wednesday that police waited five days before seeking to question her son and then told her they didn't believe the shooting was self-defense.

Asked by host Al Sharpton on MSNBC TV's "PoliticsNation" whether the boy, who called 911 at the time of the incident Feb. 26, believed George Zimmerman, 28, shot Martin, 17, in self-defense, Cheryl Brown firmly replied, "Not at all."

(Msnbc.com is not naming the boy because he is a minor. Sharpton has been active in protests and petitions seeking to have Zimmerman arrested.)

ABC News reported this week that Sanford, Fla., police sources told it that the boy saw a man fitting Zimmerman's description lying on the grass crying for help seconds before he heard the gunshot that killed Martin. Many news organizations, including msnbc.com, linked to and referred to the ABC News report. Advocates for Zimmerman have argued that the report supported his attorney's claim that he fired in self-defense.

Sanford police, who have previously said they wouldn't take questions about the case, didn't answer calls seeking comment from msnbc.com on Wednesday.

The shooting occurred Feb. 26, and Brown's son called 911 to report it at the time. But police didn't seek to question him until March 2, Brown said. She wasn't home, so they returned March 5, meaning eight days passed before police actually questioned a key eyewitness.

"I was waiting every day for someone to come knocking on the door," she said.

Once they did, Brown alleged, police tried to lead her son to agree to certain assertions, such as the race of the person on the ground and what he was wearing. But the boy stuck to his insistence that he couldn't make out either because it was too dark.

Brown alleged that the lead investigator "told me this was not self-defense," saying she should "read between the lines" because "this was racial stereotyping."

Martin was black; Zimmerman is Hispanic.

She said the investigator said he had children of his own "and seemed angered by it," saying, "I need to prove this was not self-defense."

Brown's son was walking the family dog when he saw the person lying on the ground, she said. He went to help, but the dog escaped from its leash, so he went chasing after it rather than rushing to the person, she said.?

Police have confirmed that Zimmerman told them that Martin knocked him to the ground and began beating him. At no time did her son see anyone beating anyone, Brown said.

In the days since the shooting, the boy has reflected on whether he might have been able to help or even save Martin had he not tried to retrieve his dog, she said.

"Unfortunately, he has a lot of guilt about that," she said.

Aide says Cheney had heart transplant

WASHINGTON (AP) ? Former Vice President Dick Cheney had a heart transplant Saturday, after five heart attacks over the past 25 years and countless medical procedures to keep him going. Cheney, 71, waited nearly two years for his new heart, the gift of an unknown donor.

An aide to Cheney disclosed the surgery after it was over, and said the ex-vice president was recovering at a Virginia hospital.

"Although the former vice president and his family do not know the identity of the donor, they will be forever grateful for this lifesaving gift," aide Kara Ahern said in a written statement that was authenticated by several of the Republican politician's close associates.

Cheney was recovering Saturday night at the intensive care unit of Inova Fairfax Hospital in Falls Church, Va., after surgery earlier in the day.

More than 3,100 Americans currently are on the national waiting list for a heart transplant. Just over 2,300 heart transplants were performed last year, according to the United Network for Organ Sharing. And 330 people died while waiting.

According to UNOS, 332 people over age 65 received a heart transplant last year. The majority of transplants occur in 50- to 64-year-olds.

The odds of survival are good. More than 70 percent of heart transplant recipients live at least five years, although survival is a bit lower for people over age 65.

The former vice president suffered a heart attack in 2010, his fifth since the age of 37.

That same year, he had surgery to have a small pump installed to help his heart keep working.

Called a "left ventricular assist device," or LVAD, that device took over the job of the heart's main pumping chamber, powered by special batteries worn in a fanny pack. It helps a person live a fairly normal life while awaiting a heart transplant, although some people receive it as permanent therapy. It was one of the few steps left, short of a transplant, to stay alive in the face of what he acknowledged was "increasing congestive heart failure."

In January 2011, Cheney said he was getting by on the battery-powered heart pump, which made it "awkward to walk around." He also said he hadn't made a decision yet on a transplant, but that "the technology is getting better and better."

Cheney said then that he'd "have to make a decision at some point whether I want to go for a transplant."

By that point, Cheney had been dealing with cardiovascular problems for more than two decades.

In 1988, he had quadruple bypass surgery, two artery-clearing angioplasties and the operation to implant a pacemaker, a device that monitored his heartbeat.

In 2005, Cheney had six hours of surgery on his legs to repair a kind of aneurysm, and in March 2007, doctors discovered deep venous thrombosis in his left lower leg. An ultrasound a month later showed the clot was getting smaller.

In July 2007, he had had a minor surgical procedure to replace the pacemaker.

Cheney served as former President George W. Bush's vice president for eight years, from 2001 until 2009. Cheney was a lightning rod for criticism during Bush's presidency, accused by opponents of often advocating a belligerent U.S. stance in world affairs during wars in Iraq and Afghanistan.

Former Massachusetts Gov. Mitt Romney, the front-runner for the Republican presidential nomination, wished Cheney a "fast and full recovery" in a post on Twitter. Former Pennsylvania Sen. Rick Santorum, Romney's chief challenger, sent a written statement wishing Cheney and his family well and offering his thoughts and prayers.

Like 5 million other Americans, Cheney has had congestive heart failure, meaning his heart had become too weakened to pump properly. That can happen for a variety of reasons, but Cheney's was due to cumulative damage from his multiple heart attacks.

Heart failure kills 57,000 Americans a year and contributes to many more deaths.

Shortly after Cheney's surgery was disclosed, one prominent cardiologist ? Dr. Eric Topol of Scripps Health in La Jolla, Calif. ? raised the issue of whether someone so old should have received a new heart.

"The ethicists will get into this case," he wrote on Twitter.

Others disagreed.

"It is not too old. Age is really not a factor," said Dr. William Zoghbi of Methodist Hospital's DeBakey Heart and Vascular Center in Houston. He is incoming president of the American College of Cardiology, and he spoke from the group's annual conference in Chicago on Saturday.

Zoghbi said Cheney may even fare better than younger people whose immune systems more actively fight new organs, raising concern about rejection.

"I don't see any ethical issues here," Zoghbi said, because a transplant is clearly indicated for someone whose heart is as weak as Cheney's was.

A heart transplant is a race against time. Doctors look to the waiting list for the next qualified candidate who is a good match to the newly donated heart, which typically comes from an accident victim. The patient must get to the operating room quickly, as a newly donated heart stays fresh for only about four to six hours.

During a heart transplant, a mechanical pump keeps blood flowing through the body while surgeons remove the diseased heart ? and in Cheney's case, the previously implanted LVAD ? and connect the new one.

Patients must take immune-suppressing medication for life, to keep their body's immune system from attacking the new, foreign organ. They typically stay in the hospital for a week or two, and require intensive cardiac rehabilitation.

Congressmen ask devs of 34 iOS apps about user privacy

Image
In the wake of the Path address book fiasco, Congressmen Henry Waxman (D-CA) and G.K. Butterfield (D-NC) have followed up their initial query to Apple about privacy issues by contacting the people and companies behind 34 iOS apps. The list includes Tim Cook (again), concerning Apple's own Find My Friends, Mark Zuckerberg and Path's CEO Dave Morin, among others. The letters themselves are open for viewing on the Committee on Energy and Commerce's website, and include questions about exactly how many times the apps have been downloaded, what information they transmit back from user's devices and what happens to that data. The devs have until April 12th to respond, and while we're not sure what will happen after that, we're pretty sure this ends with someone's Hall of Fame consideration in doubt despite seven Cy Youngs and more than 4,000 strikeouts.

(AP) ? Each time Tim Tebow steps on the field for the New York Jets, defenses will know what to expect.

Well, the unexpected, of course.

The versatile and elusive quarterback with the flair for dramatic victories was acquired Wednesday from the Denver Broncos and will give the Jets' offense a boost ? for at least a few snaps a game.

"Instead of a team just preparing for our base offense, they will have to prepare for what we do and what we may do," coach Rex Ryan said at LSU's pro day Thursday in Baton Rouge, La.

Tebow, who arrived at the Jets' facility in Florham Park, N.J., for the first time Thursday afternoon, won't start as he did in Denver, not with New York committed to Mark Sanchez. But Tebow gives the Jets the option to run offensive coordinator Tony Sparano's wildcat offense ? the one that confused teams while in Miami with the Dolphins ? and provides an intriguing presence when games are on the line.

"Tim is an outstanding football player, and we can use him," Ryan said. "He'll fit our wildcat package. As a defensive coach, I know how hard it is to defend the wildcat. We can take it to another level with Tim. We will have things for Tebow each week."

Consider that fair warning.

"What we've seen from him, you've got to watch every time he's in there," Jets defensive end Mike DeVito said. "He has the ability to throw the ball and a great ability to run the ball, so any role we put him in, it'll keep defenses on their toes."

DeVito and the rest of the Jets know that from experience. Tebow led a 95-yard winning touchdown drive against New York last November, scoring on a 20-yard scramble with less than a minute remaining. That set off a string of stirring comebacks as the Broncos rode Tebow's incredible late-game play ? despite his ugly mechanics and passing stats ? all the way to the playoffs, including an overtime win over the Pittsburgh Steelers in the opening round.

Long before all that, Tebow already had developed a faithful following that overlooked his flaws and focused on his leadership and ability to come through in the clutch. He's bringing those same qualities to New York, but he'll be in a different role.

"They want me to come in and compete and get better, and get better as a quarterback and to help the team any way possible," Tebow said Wednesday night. "Whatever that role is, I will do my best every time I step on that field and give my heart and soul."

Sanchez will get the snaps as the starting quarterback, and Ryan and general manager Mike Tannenbaum have told anyone who'll listen that he is their unquestioned No. 1 guy under center.

"Mark is a great competitor," Ryan said. "He's our starting quarterback. We're incredibly fortunate to have two young quarterbacks with playoff experience and playoff wins. Mark has taken us to two AFC championship games in three years. That speaks volumes about him. He is just hitting his stride."

But Sanchez also is coming off a shaky season in which he had as many touchdown passes as turnovers: 26. His decision-making and leadership came under fire by fans, media and even some anonymous players in the offseason. After a quick flirtation with the idea of chasing Peyton Manning, the Jets issued a huge vote of confidence to Sanchez by giving him a three-year contract extension.

But less than two weeks later, New York traded for Tebow ? a player with a rock-star persona and an impressive resume smattered with comeback wins. Just how secure Sanchez's job is remains to be seen once he throws his first interception or has a bad drive. But what the Jets envision is Sanchez leading the offense and Tebow running the wildcat formation when they need a spark.

"If our offense is sputtering, and we have, say, three three-and-outs, and we roll this out there and it's successful, who knows?" Tannenbaum said on 1050 ESPN Radio on Thursday. "I think it will just depend on the game and the situation."

Third-and-long? Put Tebow in to make defenses dare him to throw.

Fourth-and-goal? Try to tackle the guy, who's built more like a fullback at 6-foot-3 and 245 pounds.

Oh, he's in the wildcat, which Sparano so adores? Well, defenses need to decide if he's going to take off running, hand it off or catch defensive backs napping with a toss over their heads.

"We think we can have explosive plays out of that package as well," Tannenbaum said.

So, it could be five snaps a game. Or, seven. Maybe even nine or 10. One thing's for sure: Tebow gives the Jets their first true multipurpose threat since Brad Smith, who left as a free agent last offseason.

"Excited about the tebow trade," wide receiver Jeremy Kerley wrote on Twitter. "It's obvious tht he's a winner and thts Wht we need!"

For a team that was done in last season by distractions and disharmony, Tebow's addition would appear to do little more than add to an already volatile situation. There are times Sanchez will have to come off the field when Tebow jogs onto it, something that won't please the ultra-competitive quarterback heading into his fourth season. Ryan, though, insists Tebow and Sanchez can co-exist ? and win together.

"Tim gives us another competitor," Ryan said. "I love Tim's competitiveness. He'll fit in with our team. There will be no problem at all. We care about our team first and foremost. Those two guys are just like that."

The Jets currently have four quarterbacks on their roster ? Sanchez, Tebow, recently signed Drew Stanton and Greg McElroy. Stanton signed with New York to be the No. 2 but wants out now that Tebow is here. Tannenbaum made it clear that Tebow will be Sanchez's backup, serving in the role veteran Mark Brunell held the last two seasons.

"Brunell was more like a coach, and now Mark's going to have like a brother in there, someone he can lean on and someone he can grow with ? and they can grow together at the position," DeVito said. "So, I think Mark is going to be excited."

The possibilities certainly make the Jets excited. After all, Ryan is determined to go back to the run-first, "Ground-and-Pound" approach that made them so successful in his first two seasons as coach. With Tebow on board, the Jets just might have gotten the perfect addition for Ryan's master plan.

"What we've become," Tannenbaum said while announcing the deal Wednesday night, "is a diverse, more dynamic offense that's going to make it more difficult for opposing teams to defend."

Obama putting Oklahoma pipeline on fast track

OKLAHOMA CITY (AP) ? Deep in Republican oil country, President Barack Obama is fending off criticism of his energy policies, pointing to plans to fast-track an oil pipeline that emerged after he delayed the larger Keystone XL project earlier this year.

Obama was directing federal agencies Thursday to expedite a 485-mile line from Oklahoma to refineries on Texas' Gulf Coast that would remove a critical bottleneck in the country's oil transportation system. The directive would also apply to other pipelines that alleviate choke points.

"We're drilling all over the place," Obama said in Maljamar, N.M., on Wednesday, standing alongside oil rigs on federal land. The president was announcing his plans for the expedited pipeline, a southern portion of the original Keystone XL, in Cushing, Okla., where construction is expected to begin this spring.

In oil fields and amid acres of solar panels, Obama is trying to rebut charges that he has stifled domestic energy production and been too eager to spend government money on renewable energy projects as gas prices have climbed to $3.86 a gallon. His emphasis on oil drilling is aimed at countering criticism of his rejection of the 1,700-mile Keystone XL pipeline, which would carry tar sands oil from western Canada to refineries along the Texas Gulf Coast.

For Obama's advisers, rising gas prices pose a threat to his re-election bid because they could undermine the benefits of a payroll tax cut that he made the centerpiece of his jobs agenda last fall ? Congress approved the tax cut extension in February ? and throttle the economic recovery.

Republicans view rising gas prices as emblematic of Obama's energy record and hope to tag him with the blame even though no president has much control over prices at the pump. Gas prices have risen more than 50 cents a gallon since January in response to a standoff over Iran's nuclear program that has threatened to disrupt Middle East oil supplies.

GOP presidential hopeful Rick Santorum, campaigning at a Harvey, La., company that services oil rigs, said Obama's administration should open more federal lands for leases to boost U.S. oil production and revenue for the federal government.

"Here's an opportunity for us in this country to do something about it: increasing jobs, lowering energy prices, decreasing the deficit, all of the things you would think the president of the United States would be for," Santorum said.

Mitt Romney, Santorum's chief rival for the Republican nomination, has labeled Obama's top energy advisers as the "gas hike trio," urging the president to fire three Cabinet secretaries because of the high prices.

The status of the Keystone XL pipeline has been a focal point in the heated political fight over energy development.

Calgary-based TransCanada said it hopes to complete the $2.3 billion Oklahoma-to-Texas section next year after receiving the last approvals it needs to start construction. Many of the permits and environmental reviews already have been completed as part of the larger Keystone project, company officials said.

Republicans questioned whether the executive actions by Obama would speed up the pipeline's construction and said it reiterated the need for the larger Keystone XL pipeline.

"The American people can't afford more half-measures on energy from the president. No matter what he says, the reality is he killed the Keystone pipeline and the energy production and 20,000 jobs that went with it," said Kirsten Kukowski, a Republican National Committee spokeswoman.

Obama's energy tour was also aimed at defending his administration's support of renewable energy projects, an agenda tarnished by his administration's decision to pump millions into California solar company Solyndra before it collapsed.

In an interview with American Public Media's "Marketplace" on Wednesday, Obama noted that the funding came from a loan guarantee program approved by Congress to help renewable energy companies, some of which would not succeed.

"Do I wish that Solyndra had gone bankrupt? Absolutely not. And obviously it's heartbreaking what happened to the workers who were there," Obama said. "When you look at the overall portfolio, is it right for us to make sure that we're not just cashing in our chips and letting the Chinese or the Germans develop the technologies that we know are going to be critical in the future? I'm proud to say that we're going to continue to support it."

Electoral politics remain close to the surface. Nevada and New Mexico remain top targets on Obama's 2012 election map, and while Republican stronghold Oklahoma will get scant attention from his political team, taking his message to the site of a future oil pipeline allows him to strike back at his chief critics on energy.

Obama was ending the day with a stop in battleground Ohio, talking about automobile research and development at Ohio State University in Columbus. The president has cited his decision to raise fuel efficiency standards to 55 miles per gallon for new vehicles by 2025 as an important step in conserving oil and saving consumers at the gas pump.

Obama has repeatedly invoked his decision to rescue General Motors and Chrysler from collapse with billions in federal aid, a move that saved hundreds of thousands of auto assembly and supplier jobs in Ohio, Michigan and elsewhere. Romney opposed the bailout, and Obama's team intends to make it a stark contrast between the two candidates if the former Massachusetts governor wins the GOP nomination.

Display is Now Profitable with Re-Targeting | MediaMind Creative ...

MediaMind revealed today the results of a new case study for ZUJI Travel, a Travelocity company, showing that with optimized re-targeting, display is now profitable.

?With this latest solution, display is for the first time is an ROI-positive channel, and we are generating actual business profit for ZUJI from display advertising.? Marc Lomas, commercial director of Cadreon Australia.

Part of the global Travelocity group, ZUJI offers consumers travel deals from more than 400 airlines, 60,000 hotels and thousands of car hire, activity leisure providers and travel insurers. ZUJI needed a way to strengthen the connection between traffic to its sites and actual conversions, engaging consumers even after they left ZUJI?s website.

ZUJI?s vision was to create a personalized display campaign that would serve up the latest and best ZUJI deals relevant to each consumer?s travel intent ? anywhere they browsed on the web. ZUJI engaged Cadreon and MediaMind to develop a data-driven digital remarketing campaign.

The MediaMind platform was synced with ZUJI?s live travel database so it could automatically search and pull new travel deals into the display ads. These personalized ads would then feed into Cadreon?s vast network to be served to individuals wherever they were. The system also had to be time sensitive, dropping targeted ads after an appropriate time period or after the individual registered new site behavior on ZUJI, such as booking a flight.

?We might not be able to afford prime time advertising in Western Australia, for example, but we know we can target Perth users with special deals with online geo-targeting using MediaMind. It gives us deep reach that we couldn?t otherwise afford.? ? James Gaskell, managing director of ZUJI Australia

Using the solution, ZUJI could successfully identify an individual?s flight or holiday intent and retarget them with relevant advertising almost anywhere they went on the web. MediaMind technology also enabled ZUJI to track orders or basket value in order to optimize marketing spend on sites that generated higher-value travel purchases.

Results
Six months after launch, the campaign hit or exceeded all its KPIs for CPA, reach and frequency. In fact, it is the first time in ZUJI?s history that a display campaign has been profitable.
? CTR +300%: Display CTR went from 0.04% (July 2011) to just under 0.12% (December 2011)
? Basket value +25%: Order value is approximately 25% higher than the average for display
? Low CPA: The campaign maintains a low CPA thanks to its lower burn rate in terms of overall impressions served.
? A better customer experience: ZUJI customers are served relevant, intent-based creative that is actually helpful in travel planning.
