Colorado shooting bombshell: Defense says suspect was psychiatric patient

The lawyers said former graduate student James Holmes was being treated by Dr. Lynne Fenton, a board certified psychiatrist at the university?s Anshutz Medical Campus in Aurora, Col.
The new details are likely to raise questions about whether the trained mental health expert could have ? or should have ? identified Mr. Holmes as a danger to the community prior to the July 20 mass murder.
The new details also add another layer of mystery concerning a ?package? that was discovered at the university on Monday. It had been mailed by Holmes prior to the massacre and was addressed to Dr. Fenton.
Press reports said the package included a notebook with crude drawings and descriptions of an attack.
If accurate, such a notebook might be used by prosecutors to bolster the already significant evidence that Holmes carefully planned his midnight assault on a defenseless audience of moviegoers at the premier midnight showing of the new Batman film. Such evidence of careful premeditation would undercut arguments that Holmes snapped, or went temporarily ?postal? prior to and during the shootings.
The notebook might also be useful in identifying a motive behind the attack, and Holmes? apparent affinity with ?the Joker,? a villain in the Batman films.
Holmes colored his hair red before the attack, and reportedly told police he was the Joker.
Holmes? status as a psychiatric patient was revealed in a motion ? filed to the trial judge in the case ? accusing prosecutors and/or investigators of leaking privileged details about the package and Holmes? attempted communication with his psychiatrist to the media on Thursday.
The lawyers, Daniel King and Tamara Brady, are both employed by the Colorado public defender?s office. They asked the judge to impose sanctions against the state, including an order that prosecutors immediately produce to the defense all information and evidence related to the seized package, including the names of everyone with access to the evidence.
?The government?s disclosure of this confidential and privileged information [to the media] has placed Mr. Holmes? constitutional rights to due process and a fair trial by an impartial jury in serious jeopardy,? the lawyers wrote.
Colorado District Court Judge William Blair Sylvester had earlier ordered both sides in the case to sharply limit pre-trial publicity. He issued a brief ruling on Friday, setting a hearing on the improper disclosure issue for Monday morning ? Holmes? next scheduled court date.
The district attorney?s office denied the accusation that it was responsible for any leaks of information. As proof, prosecutors identified four details in earlier media accounts that they said are inaccurate.
Contrary to earlier reports, the FBI did not take possession of the package and its contents, prosecutors said. That action was taken by the Aurora Police Department.
One news account said police obtained two search warrants. That also was inaccurate, prosecutors say. They say the police obtained only one search warrant prior to seizing the package.
Third, prosecutors say media accounts suggesting police are examining the contents of the package are inaccurate. ?The contents were secured and not examined, and [are being] held for potential in camera review,? the state?s brief says. The reference to ?in camera review? means review by the trial judge in a non-public setting.
Prosecutors said the media was also wrong in reporting that Holmes told the police about the package. ?While the People have seen this report in the media, the People believe that it is just another inaccurate media report floating adrift in a sea of inaccurate media reports relating to this case,? the prosecutors said.
The district attorney?s office did not stop there. Prosecutors suggested that some reporters may be making information up to flesh out their news reports.
?These factual errors lead the People to believe that there may not even be a ?law enforcement source? ?leaking? confidential information and that the media is getting information from hoaxers, fraudsters, or maybe from nobody at all by creating fake ?law enforcement sources? out of whole cloth,? they wrote. ?To put it bluntly, the People are extremely dubious of the media assertions that ?law enforcement sources? exist.?
Holmes was a graduate student studying neuroscience prior to his decision to withdraw from the university on June 10. He is expected soon to be charged with 12 counts of first-degree murder and dozens of other counts of attempted first-degree murder.
The shooting rampage at the dark and crowded movie theater in Aurora left 12 dead and 52 wounded. Holmes was dressed in black clothing, wearing a bullet-proof vest, and was armed with tear gas, a shot gun, an AR-15 assault rifle with 100-round magazine, and a pistol.
Prosecutors have not yet announced if they will seek the death penalty.

Minecraft: New Town Zoning | MyFallen Gaming Community

As MyFallen continues to grow, we must grow with it, but as with anything else, there are growing pains. We are starting to see a number of member-developed towns spring up on the map. This is a good thing and we encourage it. However, it does create a good deal of work for us and as such we need you all to work with us to make it a good experience for all.
So, if you want your town to be recognized and zoned as an actual town with a warp, entry and exit message, and subregions, you will need to submit an application here.
Your application for town zoning MUST include the following:
- Why you want your town to be an officially recognized town.
- The plan for your town, including how many people you will allow to build there, size, amenities, theme, etc.
- How many people have committed to living in your town. You MUST have at least 5 (including yourself) to be considered for town zoning.
- Proposed name of your town.
- Requested warp name if town zoning is approved.
- Town location.
- Town rules.
The MFGC Staff will review your application and determine if it is acceptable or not. We may require you to provide additional information in order for us to make a decision. Decisions are made on a weekly basis, so it may take several days to get a response, depending on when you apply. Please be patient. We reserve the right to ask for changes in your name, plan, etc before approving your town for zoning.
If your application for town zoning is approved, you will be granted the following:
- Full town status and zoning.
- Warp for your town.
- Protected region for your town.
- Entry/exit message of your choice for your town.
- Subregions will be allowed and set by mods for a fee. $2K MFC (MyFallen Cash) per add or change of subregions. Initial plot owners will get free region protection as always.
- Listing of your town in the Town Registry at Spawn. (To be added before launch of this program.)
If you choose not to apply for town zoning you can still build your town, and we will protect it as one region, but we will not give it a warp or do subregions for individual plots. You can let people live there and build, but they will be added to the region for the entire town, not just their plot.
Also, starting now, mods will charge $5K MFC per region permissions change after the initial region is set up. So if you want to add your new best friend Steve to your area, so you can share a house, it will cost $5K MFC. And when you and Steve have a fight and you want him kicked out, it will cost you $5K MFC to remove him from the region. Initial region protection will remain free as always.

BEIRUT (AP) ? Syrian troops clashed with rebels in the city of Aleppo for a second day Saturday, forcing inhabitants to flee to safer areas in some of the fiercest fighting to date in a key bastion of support President Bashar Assad, activists said.
The rebels are trying to seize the momentum after a week of battles in the capital, Damascus, including a bombing that struck at the heart of the regime, killing four high-level officials.
Two days of clashes in Aleppo's Salaheddine district brought sustained fighting to the city's center for the first time since the uprising began in March 2011.
The city, a commercial hub and Syria's largest population center, has remained largely loyal to Assad and been spared the kind of daily bloodshed that has plagued other cities.
But Aleppo-based activist Mohammad Saeed said dozens of fighters from the rag-tag Free Syrian Army entered Aleppo from the countryside and were fighting regime troops from inside.
"This night was very bad, there were huge explosions and the gunfire didn't stop for several hours," Saeed said via Skype. "The uprising has finally reached Aleppo."
Damascus and Aleppo are both home to elites who have benefited from close ties to Assad's regime, as well as merchant classes and minority groups who worry their status will suffer if Assad falls.
But for months, rebels have been gaining strength in poorer towns and cities in the Aleppo countryside, gaining footholds near the Turkish border.
Activists and residents reported a tense calm in Damascus Saturday, although sporadic gunfire and explosions could be heard.
Two residents who did not want to be identified for safety reasons said by telephone that the fighting peaked between 1 a.m. and 3 a.m. local time.
One of the residents said most shops in the capital were closed Saturday and traffic was light.
Authorities have set up checkpoints at the entrances of Damascus in an effort to separate it from rebellious suburbs, and the resident said many grocery stores and vegetable vendors were unable to get supplies.
Piles of rubbish were starting to pile up in many parts of the city.
"The tension is palpable, people are scared about what might be coming," the resident said by telephone from the upscale middle class Mazzeh district. "A lot of people are just staying at home."
The Britain-based Syrian Observatory for Human Rights and a Damascus-based activist said two people were found dead in the Midan district after regime forces stormed their apartment. The activist, who gave his name as Omar al-Dimashqi, said the pair had been stabbed with knives, but that could not be independently confirmed.
Syrian forces recaptured the battle-scarred neighborhood on Friday and proudly showed reporters the dead bodies of rebel fighters lying in rubble-strewn streets.
The fighting in Damascus has sent thousands of Syrians pouring into neighboring Lebanon and Iraq.
Iraqi officials said about 1,000 nationals had left in eight flights from Damascus over the last two days to escape the escalating civil war. Thousands more poured through a land crossing despite the rebel takeover of a major Syria border post
Capt. Saad al-Khafaji of the state-owned Iraqi Airways said Iraqi authorities sent four airplanes to Damascus airport Saturday to evacuate Iraqis stranded in the Syrian capital.
"The planes are waiting for Iraqi passengers, but few are showing up at Damascus airport," he said, adding it was due to difficulties in reaching the airport because of the violence.
Anger has been building inside Aleppo at the government's deadly crackdown on the uprising and in recent months, huge anti-government demonstrations have broken out, particularly among students at Aleppo University.
In May, Syrian forces stormed student dormitories during an anti-government protest at the university, firing tear gas and bullets in an hours-long siege that killed four students and forced the closure of the state-run school.
The Local Coordination Committees activist network and the Britain-based Syrian Observatory for Human Rights said the fighting that began Friday in Aleppo forced many residents to flee to safer areas.
An amateur video posted online by activists showed Aleppo residents walking with bags of belongings or packing into cars and driving away.
Another video showed protesters pounding an iron bust of Assad's late father, Hafez, with rocks in an attempt to break it. The videos could not be independently verified.
Syrian authorities did not comment on the fighting in Aleppo. State-run news agency SANA said Syrian forces overnight thwarted several infiltration attempts by "armed terrorist groups" from Lebanon at Talkalakh in the suburbs of the central Homs province. The regime refers to the rebels as "terrorists" instead of opposition elements seeking reform.
Clashes caused grave losses among the ranks of the terrorists, it said, without elaborating.
In Homs, regime forces shelled rebel held districts, part of a monthslong effort by the government to recover those areas. Amateur videos showed shells falling on the Jouret al-Shayah district in Homs, and at least two homes in apartment buildings on fire.

CFTC chief admits failure; Iowa broker says money gone
WASHINGTON (Reuters) - U.S. futures market regulators scrambled on Tuesday to take new steps to prevent another broker from dipping into client funds, while it emerged that the founder of Peregrine Financial Group had already spent the more than $100 million he took from clients to keep his firm afloat.
As the chief of the Commodity Futures Trading Commission acknowledged that the regulatory system had failed to protect customers of PFGBest, as Peregrine is known, new details from Russell Wasendorf Sr.'s confession and suicide note showed a man embittered by "mean spirited" regulators and distraught over deceiving his own son.
PFGBest collapsed last week after Wasendorf Sr. attempted suicide, bringing to light a fraud that had lasted nearly two decades. It dealt a new blow to confidence in the futures industry, less than a year after MF Global Holdings Ltd's bankruptcy, which left customers with a $1.6 billion shortfall and is still being investigated.
Wasendorf, being held in an undisclosed location after being arrested on July 13, lacks the funds to hire a lawyer and will be represented by a public defender, said Chicago-based attorney Tom Breen. Wasendorf had intended to hire Breen.
"I know you will be shocked to discover my crimes," Wasendorf, 64, wrote to his son, Russell Wasendorf Jr., in the suicide note, a copy of which was read to Reuters by a source close to the situation. "I never wanted you to know the kind of guy I really was."
Regulators including the Commodity Futures Trading Commission have been criticized for failing to catch the deceit. Wasendorf blamed them for driving him to commit fraud by undermining his company in 1993, just a year after it was formed, the Wall Street Journal reported.
In a signed letter found with his suicide note last Monday, Wasendorf said that his scheme began around 1993, when a CFTC investigator in Kansas City sought to fine his firm for a violation involving customer funds, according to the Journal.
The CFTC "harassed" him by conducting six on-site audits over five months, he wrote. He said a "technical violation" then raised his capital requirements.
"Most of the misappropriated funds went to maintain the increasing levels of Regulatory Capital to keep in business and to pay business," he wrote.
CLOSING THE LOOPHOLE
Meanwhile regulators moved quickly to close up the loophole that Wasendorf exploited to fool authorities. He confessed to using doctored paper bank statements to show inflated customer funds, resisting efforts to allow regulators to check his bank accounts electronically. He allowed them access on July 8, a day before he attempted suicide.
CFTC Chairman Gary Gensler, in testimony before the Senate Agriculture Committee, outlined his agency's plans to contain the fallout from the Peregrine case, including new rules that would allow direct access to brokers' bank accounts and a reassessment of the role of self-regulatory organizations.
"Although we do not know the full facts of what happened in this matter, the system failed to protect the customers of Peregrine," Gensler said. "Just like the local police cannot prevent all bank robberies, however, market regulators cannot prevent all financial fraud.
"Nevertheless, we all must do better."
The National Futures Association (NFA), which was Peregrine's front-line regulator, together with other SROs including CME Group later said that they would "immediately begin the process of confirming the balances of customer segregated bank accounts for all (futures brokerages)."
"YOUR MISTAKE WAS TRUSTING YOUR FATHER"
In his suicide note to his son, Wasendorf said: "I beg your forgiveness ... Your mistake was trusting your father, nothing more." Wasendorf Jr. was chief financial officer of Peregrine.
But he had no sympathy for regulators: "I have to say I don't feel bad about deceiving the regulators," the note said. "They made the decision to be my enemy."
Gensler and other regulators have been in the hot seat over recent scandals at major financial companies, raising almost as many questions about oversight as about the conduct of the companies themselves.
A botched trading strategy at JPMorgan Chase that triggered a mounting multibillion-dollar loss and a widening scandal over large banks' alleged manipulation of Libor have also sent shivers through markets and led to calls for tougher financial rules.
"If anyone is wondering why we need these rules, all you need to do is turn on the news," Senator Debbie Stabenow, chairwoman of the Senate Agriculture Committee, said in a statement.
SCRUTINY OF SELF REGULATION
As senators questioned Gensler over the fraud at PFGBest, many criticized the National Futures Association.
"I find that mind-boggling that no one at NFA could discern this," said Senator Tom Harkin, an Iowa Democrat.
Gensler acknowledged the need for the CFTC to "examine the examiners."
"The recent events at Peregrine highlight the necessity of looking at the decades-old system of SROs as first-line regulators and the commission's role in overseeing SROs," Gensler said.
New rules aimed at boosting protections for futures customer money were sent to commissioners' offices on Monday evening, Gensler told reporters after the hearing.
In addition to improving direct access to brokers' bank and custodial accounts, the rules would give customers more transparency into their holdings. Some brokers including independent Rosenthal Collins Group and Citigroup have moved over the past week to open a window on customer funds in an effort to restore traders' trust in the system.
But even as lawmakers agreed on the need for better customer safeguards, Republicans pulled no punches in their critique of the CFTC's swaps and futures regulations, mandated by the 2010 Dodd Frank law.
"The CFTC has told no one how it plans to coordinate the implementation of the over 30 rules and thousands upon thousands of pages of new regulations it has created," said ranking Republican Senator Pat Roberts in his opening statement.
"And as if this weren't bad enough, the CFTC isn't doing a good job of what it was created to do and that is police the financial streets."
TWO VIOLATIONS
The MF Global and PFGBest scandals have raised questions about the strength of federal commodities regulations designed to segregate and protect customer funds.
The NFA eventually uncovered the fraud after it sought to confirm PFGBest's bank balance electronically. Prior to that, the NFA had conducted such checks through the mail. Wasendorf used a post office box to intercept the bank confirmation requests and forge documents to conceal the missing customer money, according to an FBI complaint.
Gensler said on Tuesday that the NFA had completed an audit of the brokerage in May 2011 and was in the process of conducting another one over the past few weeks when the fraud was uncovered.
NEW RULES TO SAFEGUARD FUNDS
On the same day as Wasendorf's arrest, the CFTC moved to approve new customer protection rules requested by the NFA.
One such rule, named for MF Global's former CEO, Jon Corzine, would require top executives at futures brokers to sign off on major withdrawals from customer accounts.
But Gensler said on Tuesday that more steps need to be taken.
"I believe it is critical that we bring the regulators' view of customer accounts into the 21st century," he said. Letters confirming bank balances "must come directly to regulators from banks and custodians," he said.
Gensler said he hopes to incorporate the new NFA regulations approved last week into the commission's own rules, so it can "directly enforce" the reforms.
He said he has asked for a public roundtable to discuss what other customer protections are needed.
